Serious water utility charge decision overturned

Councils have been waiting for the outcome of the LGAQ/Mount Isa City Council Appeal against the December 2017 decision by Justice Martin Daubney which invalidated Mount Isa City Council’s water utility charge due to failure to comply with the Local Government Regulation 2012 and Local Government principles.

The Court of Appeal has unanimously set aside the orders from the original decision, and refused the Mount Isa Irish Friendly Association Ltd original request for relief.

The Court of Appeal judgement found many errors in law in the original judgement.

The Society has been ordered to pay costs of the Appeal and each proceeding.
