Have your Say: Amendments to Queensland’s building laws and security of payment legislation

The Building Industry Fairness (Security of Payment) and Other Legislation Amendment Bill 2020 (the Bill) has been introduced to the Queensland Parliament.

It includes amendments covering a range of reforms of significance to local government, such as seeking to strengthen the building certification and inspection processes in Queensland and also enhance Queensland’s security of payment laws 

Specifically, the explanatory notes detail that the objectives of the Bill are to: 

  • implement the recommendations of the Building Industry Fairness Reforms Implementation and Evaluation Panel 

  • implement the recommendations of the Special Joint Taskforce that investigated subcontractor non-payment in the Queensland building industry 

  • enhance Queensland’s security of payment legislation and further extend the protections for industry 

  • improve the Queensland Building and Construction Commission’s ability to address fraudulent behaviour in the industry 

  • strengthen Queensland’s building laws to enhance regulatory oversight capabilities, clarify licensing requirements, improve building safety and support industry professionals 

  • implement reforms arising from the Queensland Building Plan to strengthen the certification and inspection process and improve professional standards and compliance in the certification sector 

  • implement reforms arising from the Building Confidence Report such as enhancements to the regulation of architects and registered professional engineers, and 

  • ensure the continuation of external review rights for decisions about transition plans for retirement village schemes.

The LGAQ will be making a submission on the Bill and welcomes member feedback to inform its submission. Members wishing to contribute are invited to provide feedback on any aspects of the Bill to Crystal Baker, Lead – Planning and Development by COB Friday, 21 February 2020

Background

On 5 February 2020, the Hon Mick de Brenni MP, Minister for Housing and Public Works, Minister for Digital Technology and Minister for Sport, introduced the Building Industry Fairness (Security of Payment) and Other Legislation Amendment Bill 2020 (the Bill) into the Queensland Parliament. 

The Bill will amend the following legislation:  

  • Architects Act 2002 

  • Building Act 1975 

  • Building Industry Fairness (Security of Payment) Act 2017 

  • Professional Engineers Act 2002 

  • Queensland Building and Construction Commission Act 1991 

  • Retirement Villages Act 1999 

The Bill has been referred to the Transport & Public Works Committee for detailed consideration and the closing date for written submissions on the Bill to the Committee, is 4pm Wednesday, 26 February 2020.
